The importance of having a will in place cannot be underestimated , not least because a well drafted will can make sure the people that you want to , can inherit your estate.

Writing a Will is one of the most important personal decisions you will make. Nobody likes to think about it too much because it is a reminder of their own mortality but it is vital that your final wishes are clear and legally binding.

A Will also allows:-

  • (1) Executors to be appointed to take responsibility for dealing with the affairs of the deceased
  • (2) Guardians to be appointed for any minor children
  • (3) Trustees to be appointed to manage the estate so as to benefit minors or those with a disability.

Wills can be more complicated than that . For example , many people are not aware that as the law stands, couples who are not married or who are not in a Civil Partnership, have no entitlement to the other’s estate on death, if they die without a Will.

Also, if a person dies Intestate who is separated and their divorce is yet to be finalised, their spouse stands to inherit everything as they are still legally married at the time of death. This applies even if the deceased has formed a new relationship.

It is always preferable to seek the advice of a Solicitor specialising in Wills and Estate Planning who will have years of experience dealing with Clients and who will be able to draft a Will to take into account all of your personal circumstances, no matter how complex they may be.
