New guidance: European Patent Office publishes guide to the Unitary Patent
Businesses with patents, or inventions that could be patented, will welcome publication of a free guide to the proposed Unitary Patent published by the European Patent Office (EPO).
The guide explains what a Unitary Patent is, ie. an alternative to the existing options of registering national patents or asking national patent offices to validate European patents. It also sets out the procedure for obtaining and renewing a Unitary Patent and the legal remedies available if a party is unhappy with an EPO decision.
The guide also sets out other useful guidance, including what information will be available about a Unitary Patent, and how to record changes of ownership and grants of a licence in respect of a Unitary Patent
It also comments on the current uncertainty over whether the UK will participate in the Unitary Patent once it leaves the EU.
