Types of Trust Disputes

Trust disputes can arise for various reasons, such as disagreements over the interpretation of the trust terms, questions about the trustee’s management of the trust, or conflicts among the beneficiaries. Some common types include:

  • Breach of trust: This occurs when the trustee fails to fulfil their fiduciary duty to manage the trust prudently and in the best interests of the beneficiaries.
  • Trust modification or termination: Beneficiaries or trustees may seek to modify or terminate the trust due to changes in circumstances or other reasons.
  • Disputes over trust distributions: Beneficiaries may disagree over how trust assets should be distributed or spent.
  • Disputes over trust assets: Disputes may arise over the ownership or control of trust assets, especially if the trust contains valuable or complex assets such as real estate or investments.
